TERMS AND CONDITIONS

These Terms and Conditions govern the 1865 Programme (hereinafter called "1865" or "Programme") operated by or on behalf of Langham Hotels International Ltd. (hereinafter called "LHI") and our relationship with members of the Programme (hereinafter called "Members" or "You"). The terms and conditions stated hereunder supersede the ones for the previous Langham Privilege Club. Membership of the Programme is subject to these Conditions, which are the only conditions that apply to the Programme. By using your 1865 Card or Card Number to redeem benefits and services associated with the Programme, you agree that:
a. you have read, understood and accepted these Conditions;
b. you are eligible for Membership; and
c. you consent to LHI processing data that is personal to you, in accordance with the personal data and privacy policy as set out in Section 3.

1. MEMBERSHIP OF THE PROGRAMME
1.1 When you join the Programme, you will be assigned a 1865 membership number and will receive your personalized 1865 Card along with details on programme benefits and a list of participating hotels.
1.2 Membership is complimentary and is available only to individuals, not to companies, partnerships, associations, groups or other entities. You may not have more than one membership or any form of joint membership. It is your responsibility to ensure your eligibility and you will indemnify LHI against all liabilities, costs, claims, and/or expenses incurred for any breach of this provision. LHI may refuse Membership without giving a reason.
1.3 Membership entitles members to benefits and services according to entitlements as described under Section Benefits and relevant further information within these terms and conditions.
1.4 Membership of the 1865 and membership cards are not transferable and may only be used by the registered member. Membership cards remain the property of LHI and must be returned upon request.
1.5 You may cancel your Membership at any time with wrien notification to the Hotel and enclosing your 1865 Card (if any) cut in half. Cancellation is immediately effective from receipt of your cancellation request and all membership entitlements will be forgone upon cancellation.
1.6 LHI reserves the right to discontinue the 1865 membership for any Member who is found to be using the Programme in a manner inconsistent with the Terms and Conditions or intent of the Programme or any portion of the Programme. LHI also reserves the right to discontinue membership for any Member who acts in a manner inconsistent with the spirit of the 1865 Programme. Discontinued membership will result in the loss of all membership entitlements.
1.7 Any Member who has not stayed at a 1865 participating hotel once in 12 consecutive months may be removed from the list of active Members and if so, is subject to forfeiture of all benefits and services. A Member may reactivate his or her account by any means that LHI may establish.
1.8 Unless otherwise stated, all benefits available to Members through the Programme are subject to availability and certain benefits may be excluded from certain volume room night agreements.
1.9 Unless specified otherwise at time of check-in, airline miles will be awarded to the member's preferred airline frequent flyer programme account for the stays where member pays an eligible rate.
1.10 Valid credit card information must be provided to facilitate selement of hotel bills and entitlement of certain member benefits. Unless specified otherwise at time of reservations or check-in, Langham properties and Langham affiliated hotels will use the credit card information provided by members to 1865 for bill selement purpose.
1.11 LHI reserves the right to add, modify, delete or otherwise change any of the terms, conditions, benefits and services pertaining to the Programme at its sole discretion, at any time without prior notice.
1.12 1865 Card is a guest recognition membership card and is not a credit card.
1.13 All interpretations of the Programme's Terms and Conditions shall be at the sole discretion of LHI.

2. TIERS OF MEMBERSHIP
2.1 Gateway Level. You are eligible for a 1865 Gateway membership if you have stayed at Langham Hotels or LHI's affiliated hotels at least 3 times within a consecutive period of 12 months.
2.2 Voyager Level. You are eligible for a 1865 Voyager membership if you have stayed at Langham Hotels or LHI's affiliated hotels at least 5 times within a consecutive period of 12 months.
2.3 Destiny Level. The 1865 Destiny membership is reserved for Voyager members showing the highest level of commitment. The membership is offered by invitation at the sole discretion of LHI.
2.4 Every effort will be made to invite guests to join 1865 when the above targets are met however ask that you inform us if you have reached these targets and not yet been invited to join the programme.
2.5 The Programme will not recognize number of stays offered on a complimentary basis or generated from airline crew accounts.
2.6 Long stay agreements are generally specifically contracted for extended periods so certain benefits with the 1865 programme may not apply.

3. DATA PRIVACY
3.1 The personal data supplied by Members is required for the operation of the 1865 Programme, delivery of associated benefits and services, programme development and to communicate news and information to Members for their benefits.
3.2 LHI collects information about our Members (both offline and online) so as to provide an experience that is tailored to their preferences. Since the privacy of Members is of paramount importance to LHI, we wish to protect it and maintain the trust of our Members while collecting the information necessary to operate this Programme. LHI is fully commied to providing information about the collection and use of personal information furnished by, or collected from, Members while using our websites, products and services. We offer Members the choice to decline (opt out) participation in certain services and promotional benefits provided by LHI and/or its carefully selected third parties.
3.3 Members have the right to review, amend and update any personal data held by LHI. Members' contact details, profiles and guest history can be accessed at any time online by individual members. The member restricted access is password secured and allows you to view your accumulated stays and you may change contact details and personal preferences.
3.4 Members are responsible for keeping 1865 up-to-date as to their correct communication/postal address.
3.5 LHI will only use and disclose Members' data to the companies within the Group, their successors and business partners and any suppliers LHI engages to process data on our behalf for the purpose of operating this Programme.

4. GENERAL
4.1 These Terms and Conditions and the relationship between 1865 Members and Langham Hotels International Limited are governed by and shall be construed in accordance with the laws of Hong Kong SAR.
4.2 "Langham properties and LHI's affiliated hotels" include all 1865 participating hotels. Please check website for details.
4.3 Member shall indemnify and hold harmless LHI, its officers, directors, employees and agents (collectively "Representatives") from and against any and all liabilities, damages, losses, expenses, claims, demands, suits, fines or judgements (including without limitation, any reasonable legal fees, costs and related expenses) incurred or suffered by LHI and its Representatives as a result of any claims or proceedings brought by any third party arising out of or in connection with any breach of obligations hereunder or negligence or wilful misconduct on the part of the Member
